Effective Date: 2024-10-27

This Asynchronous Session Agreement ("Agreement") is made by and between Cosmic Biz Witch LLC, a limited liability company organized under the laws of the State of California ("Session Provider"), and you ("Participant"), as a participant in the session described below.

This Agreement governs your participation in the Daily Planet Codes session (“Session”), including access via the Telegram platform (“Container”) and any materials, services, or interactions provided therein.

Article 1 – DEFINITIONS
Session Name: Daily Planet Codes

Session Description:
A private 7-day Telegram experience delivering personalized astrological voice notes and live written reflections exploring your unique relationship to each of the 7 planets—so you can align your workflow and life-flow with your energetic design.

Session Format: Voice messages and text chat inside a private Telegram thread.

Preparation Period: Up to 7 days from time of purchase.

Session Start Date: The first Monday following the preparation period.

Session End Date: The following Sunday, 7 days later.

Materials Provided: Plan with the Planets digital guide (PDF).

Support Email: support@cosmicbizwitch.com

Fees: Paid in full at time of purchase, as displayed at checkout.

Refund Policy: No refunds due to the nature of digital delivery and preparation.

Article 2 – ASSENT & ACCEPTANCE
By purchasing and participating in the Session, you agree to be bound by this Agreement. If you do not agree, discontinue participation immediately. Purchase constitutes acceptance.

Article 3 – LICENSE TO USE MATERIALS
You are granted a non-exclusive, non-transferable, limited, and revocable license to access and use all provided materials (including the Plan with the Planets guide) for personal use only. Redistribution, resale, or use in any coaching or commercial context is strictly prohibited.

Article 4 – SESSION TERMS
Upon purchase, you agree to allow up to 7 days for preparation of your customized materials. Your Telegram thread will open on the next Monday, and the session will run for 7 consecutive days (Monday through Sunday).

You are encouraged to engage throughout the week. If you delay in responding, we will still honor the 7-day container, but your level of engagement may impact the depth of your results and support. The experience will not be extended beyond the 7-day window.

You will retain access to the thread indefinitely, but message exchange and personalized support will conclude at the end of the 7 days.

Article 5 – EXPECTATIONS & OUTCOMES DISCLAIMER
This Session is for reflection, self-inquiry, and energetic alignment. No outcomes or results are guaranteed. You are solely responsible for your actions and results. This Session does not constitute therapy, financial advice, or medical guidance.

Article 6 – INTELLECTUAL PROPERTY
All session content, including voice notes, PDFs, worksheets, and written insights, are the intellectual property of Cosmic Biz Witch LLC. You are purchasing a license to use these materials personally, not the rights to reuse, distribute, or republish them.

Article 7 – PROHIBITED USES
You agree not to:
- Copy, reproduce, or distribute any materials or voice notes
- Use the content in any client-facing service or business program
- Share the Session access or content with others, free or paid
- Upload content or messages to any public or group platform
- Harass, threaten, or otherwise misuse the Telegram container

Article 8 – USER CONTRIBUTIONS
You may share reflections and insights in the Telegram thread. We will not share these externally without consent. However, your participation grants us a non-exclusive license to use anonymized feedback or themes for general marketing or educational purposes.

Article 9 – PAYMENT & FEES
Full payment is due at purchase. No refunds are offered due to the digital nature of the Session and customization of materials. Access begins with delivery and is considered used once the first message is sent.

Article 10 – COMPATIBILITY & ACCESS
Telegram is required to participate. While we offer the Session in a widely accessible format (text + voice within Telegram), you are responsible for having the appropriate software and device setup. We are not liable for technical incompatibility.

Article 11 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for:
- Any results or lack thereof
- Incompatibility with your software or device
- Interrupted access to Telegram
- Emotional, financial, or physical outcomes related to the Session
- Any damages exceeding the amount paid for the Session

Article 12 – NO WARRANTIES
This Session is provided “as is.” We do not guarantee results, accuracy of astrological interpretations, or outcomes of any kind. You acknowledge that spiritual or energetic support is subjective and not measurable.

Article 13 – SERVICE INTERRUPTIONS
Telegram service outages are beyond our control. If there is a delay due to Telegram’s downtime, we will make reasonable accommodations, but cannot guarantee uninterrupted access.

Article 14 – TERMINATION
We may terminate access or remove you from the Telegram thread for violating this Agreement. Termination does not entitle you to a refund.

Article 15 – GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of California, USA. Any disputes shall be resolved in Placer County, CA, via arbitration as outlined in our company terms.

Article 16 – PRIVACY POLICY
Your name, email, and birth data are collected solely for delivery of this Session. They will not be sold or shared. For more information, review our Privacy Policy.
